Terms of Service

These Terms are an agreement between you and Validitas ("Validitas", "we", "us") for your use of the Validitas service at app.validitas.io (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service for a firm or organization, you agree on its behalf and confirm you have authority to do so.

1. What Validitas is, and isn't

Validitas screens digital files (such as screenshots, photographs, documents and audio) for indicators of editing or synthetic generation and produces screening reports. Validitas is a screening and documentation tool. It is not a forensic examination, expert testimony, a legal opinion or legal advice, and Validitas is not a law firm. Results are probabilistic and can be wrong in either direction. A finding is a reason to investigate further; the absence of findings is not proof that a file is authentic. You are solely responsible for how you use a result, including whether to rely on, offer, or challenge any evidence, and for complying with the rules of any court or tribunal. We do not guarantee that any report will be admitted into evidence or accepted by any court.

2. Accounts

You must provide accurate information, keep your password confidential, and tell us promptly at hello@validitas.io if you suspect unauthorized access. You are responsible for activity under your account. Account owners may invite members, who share the firm's screenings, reports and matter folders.

3. Your files and your responsibilities

You keep all rights to the files you upload and the reports generated from them. You grant us a limited license to store, process and transmit your files only to provide the Service to you, including sending them to the detection providers described in our Privacy Policy. You confirm that you have the legal right to upload each file and to have it analyzed, and that doing so does not violate any law, court order, protective order or duty of confidentiality. You must not upload material that is illegal to possess. If we become aware of child sexual abuse material, we will report it as required by law.

4. Acceptable use

You may not: use the Service to harass, stalk or surveil anyone; attempt to reverse engineer, probe, scrape or overload the Service or bypass usage limits; use the Service to build or train a competing product or detection model; resell the Service without our written consent; or misrepresent a report's contents, origin or meaning, including by altering a report or describing it as expert testimony, "court-certified" or "admissible."

5. Free screenings, paid reports and subscriptions

Each firm account includes a number of free screenings per calendar month, shown in the Service; unused screenings don't roll over. Paid reports are purchased individually or included in a subscription plan. Prices are shown before purchase and are processed by Stripe; we never receive your full card number. Purchased report credits do not expire. Subscriptions renew automatically each billing period until canceled; you can cancel anytime from the billing page, effective at the end of the current period, and unused plan reports don't roll over. If a check fails for technical reasons, it doesn't count against your screenings or paid reports. Except where the law requires otherwise, payments are non-refundable; if you believe you were charged in error, contact hello@validitas.io within 30 days. We may change prices with notice; changes don't affect amounts already paid.

6. Data retention and deletion

Uploaded evidence files are encrypted and permanently deleted 30 days after upload unless you place a litigation hold. Reports, file fingerprints (SHA-256 hashes) and audit logs are kept until you delete them. You can delete a report and its files at any time. A verification record containing no file contents or case information is kept so that issued reports remain verifiable. See the Privacy Policy for details.

7. Expert referrals

If you request expert review, we may introduce you to independent forensic examiners. Examiners are not our employees or agents; any engagement is between you and the examiner, on terms you agree with them. We never share your files with an examiner without your approval. We do not pay or receive referral fees based on the outcome of any matter.

8. Our intellectual property

The Service, including its software, methods, reports' format and design, and the Validitas name and marks, belong to Validitas and its licensors and are protected by law. These Terms don't grant you any rights in them except to use the Service as permitted here.

9. Confidentiality and security

We treat your files and reports as confidential and protect them with the safeguards described in our Privacy Policy. No system is perfectly secure; you are responsible for the security of your own devices and for any copies of reports you download or share.

10. Disclaimers

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT A RESULT WILL BE CORRECT OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VALIDITAS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CASES, SANCTIONS OR DATA LOSS, ARISING FROM OR RELATED TO THE SERVICE OR ANY REPORT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 IF GREATER.

12. Indemnity

You will defend and indemnify Validitas against third-party claims arising from files you upload, your use of a report, or your breach of these Terms.

13. Suspension and termination

You may cancel a subscription at any time from the billing page, and delete your account at any time from the account page. We may suspend or terminate access for violation of these Terms or to protect the Service or others. Sections 3, 6, 8 and 10 through 15 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Florida, and you and we consent to their jurisdiction.

15. Changes and contact

We may update these Terms. If a change is material, we'll notify account owners by email or in the Service before it takes effect. Questions: hello@validitas.io.
